The cost of the filters to be acquired thereafter will be determined by BIBO Water (Pty) Ltd who I authorize to debit my account on an annual basis with the cost of the filters until such time as I cancel this authorization in writing.

I hereby authorise BIBO Water (Pty) Ltd to issue and deliver debit order payment instructions to your banker for collection against my Account and Bank used by my employer to deposit my salaries / wages, which account may differ from the account specified above on condition that the sum of each payment instruction and frequency of payment requests will never exceed the obligations as agreed in Section B above. My bank’s participation in the relevant payment stream, the authentication mechanism used by me and the relevant rules applicable to the payment streams will determine per repayment cycle the most suitable payment stream in order to fulfil the obligations as defined in this agreement.

My authorization is subject thereto that the same payment instruction may never be presented simultaneously in more than one payment stream during the same repayment cycle or, if unpaid in a payment stream selected be represented in the same cycle in another payment stream. I can only service the obligations defined in here if the payment instructions are executed as close as possible to when I receive my salary or wages which dates vary from month to month, especially during December of each year.

To curb against (1) unpaid bank charges (2) losing the benefits described in this agreement (3) incurring penalties due to non-payment; I hereby agree that subsequent payment instructions will continue to be delivered in terms of the authority until all obligations have been paid. This authorisation will remain in force until cancelled by me in writing. I hereby acknowledge that my bank will charge fees to my account as agreed with them once they process this instruction. I foresee that I may change my bank and bank account particulars reflected in here, in which instance I will notify the beneficiaries specified, or any new beneficiary, should the agreement be ceded or assigned to any third party. Should I however forget to notify you, or the assigned third party and if you or the assigned third party obtain my new bank particulars, on own account, this mandate will not lapse.

This issued mandate will cover the obtained bank information, and you and the assigned third party may attach such new information, to this signed document as annexure, and the attached annexure must be read together with this mandate, by my new bank.

I agree that in the event of any debit order not being met by my financial institution my filters@home subscription will be cancelled and I will not receive any BIBO filters. Legal action will also be taken against me for the collection of any outstanding amounts and that I will also be responsible for all legal costs thereof. I also agree that ownership in the BIBO filters shall remain vested in BIBO Water (Pty) Ltd until such time as I have paid for the filters in full.

Should I breach this agreement in any manner whatsoever and without derogating from the generality thereof, the events detailed below shall be deemed to be a breach hereof, then, notwithstanding anything contained herein, BIBO Water (Pty) Ltd will be entitled to cancel my filters@home subscription and will not be required to deliver any BIBO filters to me. For the purposes of this paragraph the following shall be deemed to be a breach by me:

1. Failing to pay any amounts on due date; or
2. a provisional or final order of sequestration being granted against me; or
3. failing to have any judgment given against me rescinded within 21 days from the date that the judgment was handed down against me;

   In the event of a breach by me of the terms of this agreement, I agree to be liable to BIBO and/or its agents for the payment of:

   1. Interest of the maximum permissible rate in terms of Law on all outstanding amounts; and
   2. all costs and expenses of whatever nature incurred by BIBO as a direct or indirect consequence of
      my doing, including legal costs on an Attorney and client scale and tracing fees; and
   3. any penalties, which may be debited as a result of late payments, service fees on payments, return
      debit orders and/or dishonoured cheques; and
   4. I may be registered with one or more credit bureaus if there is any default on any payment.

A certificate signed on behalf of the Company by any director, whose authority it shall not be necessary to prove, shall be prima facie evidence of any outstanding indebtedness in terms hereof.

General

1.  None of the terms and conditions of this agreement is capable of being cancelled, waived, amended, added to or deleted, unless such cancellation, waiver, amendment, addition or deletion is reduced to writing and is signed by the parties hereto.

2. No indulgence on the part of BIBO shall constitute a waiver, variation or novation of any such right in terms hereof.

3. The provisions of this agreement shall, as far as is permitted by law, be binding upon the parties’ executors, trustees, curators, legatees, heirs and other successors in title.

4. BIBO shall be entitled, without notice, to cede all or any of its rights in terms hereof. The Undersigned payer may not cede his rights in terms of this agreement.

5. Each clause of this Agreement is severable, the one from the other, and if any clause is found to be defective or unenforceable for any reason by any competent court, then the remaining clauses shall be of full force and
   effect and continue to be of full force and effect.

6. The Local Magistrates Court shall have jurisdiction for all or any disputes which arise between the parties flowing from this Agreement or the interpretation thereof.

7. In the event of the Undersigned payer completing the form incorrectly and the details herein not being correct, this agreement shall be deemed to be amended so as to correctly reflect the details.
